Article 1

The national provisions imposing a mandatory limit value for the emissions of particulate matter of 5 mg per kilometre on commercial vehicles with a maximum permissible weight of 1305 kg (N1 vehicles, class I) and passenger cars (M1 vehicles) notified by the Kingdom of the Netherlands pursuant to Article 95(5) of the EC Treaty are rejected.

Article 2

This Decision is addressed to the Kingdom of the Netherlands.
