Article 1

The State aid equivalent to 29,9 % of eligible investment costs which Germany intends to grant to Ethylen-Pipeline Süd GmbH & Co KG (EPS) is compatible with the common market on the basis of Article 87(3)(c) of the EC Treaty up to a maximum aid level of EUR 44850000.

Article 2

This Decision is addressed to the Federal Republic of Germany.
