Article 1

The investment by the municipality of Rotterdam in the Ahoy complex, notified to the Commission by letter of 22 February 2007, with subsequent amendments, does not constitute State aid within the meaning of Article 87(1) of the EC Treaty. The measure may accordingly be implemented.

Article 2

This Decision is addressed to the Kingdom of the Netherlands.
