Article 1

The state aid which Italy plans to grant to Fri-El Acerra Srl, amounting to EUR 19,5 million, is incompatible with the internal market. Consequently, the aid may not be implemented.

Article 2

Within 2 months of notification of this Decision, Italy shall inform the Commission of the measures taken to comply with it.

Article 3

This Decision is addressed to the Italian Republic.
