Notice of intention to carry out a review of an anti- dumping measure /* PRODUCT CORNER FITTINGS ORIGIN AUSTRIA */ Official Journal C 205 , 17/08/1990 P. 0020 - 0020 Notice of intention to carry out a review of an anti-dumping measure (90/C 205/04) The Commission has received a request for a review of the measure mentioned below in accordance with Article 15 (3) of Council Regulation (EEC) No 2423/88 of 11 July 1988 (1) on protection against dumped or subsidized imports from countries not members of the European Economic Community. Following an examination of the facts and allegations contained in this request regarding the foreseeable effects of the expiry of the measure in question, the Commission has concluded, subject to a further analysis, that there is sufficient evidence that the expiry of this measure would lead again to injury or threat thereof.
In support of these allegations, the Community industry has supplied evidence that, even though a slight price increase was noted following the undertaking offered in 1985, nevertheless a tendency to decreasing prices occured on the Italian market in 1986, a market which accounts for 45 % of the total Community consumption. Because the expected positive results from the price undertaking have been offset by this depressive effect, the major Community producer was forced to withdraw and the exporters now hold a market share of more than 90 % of the Italian market. It is also argued that the major Austrian exporter, who is the biggest producer in Europe, has plans for an extension of its production capacity.
It is furthermore alleged that Community producer prices were prevented from keeping up with the increased cost of production and, should this situation persist, the viability of continued business operations on the Community producers' side would be jeopardized. The Commission therefore, after consultation, gives notice of its intention to carry out a review of the price undertaking mentioned hereinafter.
